California Supreme Court overturns state ban on gay marriage.

Initial reaction: WOOT! THIS IS SO AWESOME AND FULL OF WIN!

Secondary reaction: Squee to all and sundry!

Tertiary reaction, after squeeing at a law student: Oh. ._.

In [livejournal.com profile] jacks_shadow's words: "The odds of a State Consititutional amendment being added to California is now higher, in my opinion, because the highest court in the State looked at the voters and said, 'If you want to ban gay marriage, you're going to have to pass a law we can't overturn.'"

Well, technically [livejournal.com profile] jacks_shadow is done with law school, but he hasn't taken the bar yet, so I guess he qualifies as a larval lawyer? Dunno. But he made an excellent point: though this ruling is a mighty strike for justice and equality, it also greatly increases the chances of a constitutional amendment banning gay marriage passing (especially considering that consititutional amendments in California only require a simple majority at a referendum--50.1% means no fabulous gay weddings for Californians).

The small comfort is that even the Governator supports this ruling and has said he's not down with any constitutional amendment overturning it.

The original ban passed with about 60% of voters in favor I think, which means this decision will in all likelihood be overturned in November. I wish our proposition system wasn't so retarded :(. Still glad it happened though, and it's certainly better than them not striking it down in the first place :D.
